Residential contaminated land assessments are becoming more common because regulators need to meet their statutory obligations as detailed in Part IIA of the Environmental Protection Act 1990.

Under the this regulatory regime the land owner or occupier is liable for the contamination unless they can prove otherwise and it is the Local Authority’s responsibility to identify potentially contaminated residential land. The Local Authority has statutory powers to enforce remediation of your property at your cost. The legacy of residential housing stock built on brownfield land, land raise materials derived from industrial sources, or historic landfills means a land owner could unexpectedly receive an enforcement notice. Local Authorities now request that land owners conduct an assessment of their land when planning permission is sought and, if contamination is identified, go through a voluntary remediation process.

Insurance is available to protect the owner from the high cost of remediation. Insurance protects land owners financially, however land owners should also consider testing their land. Soil tests can demonstrate whether or not occupants are exposed to toxic or carcinogenic soil, groundwater, ground gases or ground vapours. There are many properties across the UK where families have been exposed for long periods to contaminants such as heavy metals, poly-cyclic aromatic hydrocarbons (PAH) and petroleum hydrocarbons (PCBs, DDT etc), or vapours such as benzene and chlorinated solvents. Land fill gases (such as methane and carbon dioxide,) are an added concern that also requires assessment.
